This privacy policy applies to the processing of personal data that VALKIRIA ELECTRIC S.L. (hereinafter, "VALKIRIA ELECTRIC" or "VALKIRIA") carries out concerning its customers within its websites, apps, and any other digital platform or electronic medium, including the processing of data from social media users, based on their relationship with VALKIRIA. This privacy policy is also applicable, as detailed at each moment, to the processing of personal data of potential customers related to the execution of campaigns, organization of events and activities, raffles, and promotions by VALKIRIA.
VALKIRIA ELECTRIC S.L., with C.I.F. B-42661108, located at Avenida Conde de Lumiares 34, 03015 Alicante, is the Data Controller of the data concerning the interested parties and guarantees their security and confidential processing, in accordance with the General Data Protection Regulation ("GDPR") and any other applicable regulations.

a) In the case of processing data from customers and users within VALKIRIA ELECTRIC's digital platforms
Within VALKIRIA ELECTRIC's digital platforms, the collection and processing of users' personal data will be carried out, depending on the relationship with the user, for the following purposes:
In the case of user registrations to provide access and use of the digital platform, as well as the contracting data and contact information available to that user, and to comply with VALKIRIA ELECTRIC S.L.'s legal obligations as a provider of information society services.
In the case of inquiries or requests, the information will be used for the purpose of managing them.
Similarly, user browsing data and cookies may be processed for the purposes of improving user accessibility, personalizing and analyzing navigation, as well as displaying advertising and ads based on their interests, even in advertising spaces on third-party platforms (e.g., social media, search engines, etc.), in accordance with our cookie policy and the privacy policies of those platforms to which access to such cookies is provided.
Other specific purposes indicated within the data collection forms on the digital platform, without which VALKIRIA ELECTRIC will not be able to process the relevant form.
In the case of contracting services or products through the digital platform, we inform you that the purpose will be to manage your relationship with VALKIRIA ELECTRIC, provide the requested services, manage customer support, and, in general, fulfill the obligations of the Contract. Additionally, VALKIRIA ELECTRIC may consult creditworthiness and solvency files to assess the economic solvency of the Client and, based on these consultations, make decisions that may affect them, potentially conditioning the commencement or validity of the Contract on the establishment of a payment guarantee. However, VALKIRIA ELECTRIC will always provide the Client with the opportunity to present any relevant information to defend their rights or interests. In the event of non-payment, VALKIRIA ELECTRIC may report this to such files, in compliance with current legislation.
VALKIRIA ELECTRIC may, with the user's consent, update and enrich the user's personal data by acquiring databases from publicly accessible sources that allow for improved management of the relationship and contact with the user.
VALKIRIA ELECTRIC will also process personal data in order to offer, through the provided means or via third-party platforms contracted by VALKIRIA ELECTRIC and accessible by the user, including electronic means, segmented and personalized information regarding energy supply, products, and services, either provided by VALKIRIA ELECTRIC or promoted by it from third parties, if consented to. This information may relate to energy, telecommunications, financial services, home solutions, and entertainment. To do this, VALKIRIA ELECTRIC may use automated support systems and other means to define target audience profiles for campaigns, activities, or actions, utilizing information from VALKIRIA ELECTRIC as well as data from third-party sources, provided the user has also consented to this. These actions may continue for clients even after the contractual relationship has ended, if the client has consented to this.
Additionally, VALKIRIA ELECTRIC may use anonymized user data, ensuring their anonymity, even after the relationship has ended, for the purpose of utilizing it within their support systems for decision-making and business management, as well as for optimizing customer management systems.
b) In the case of processing data from potential customers in promotions, communication campaigns, and events
VALKIRIA ELECTRIC may process the data collected from potential customers for various purposes depending on the context of the activity carried out. Thus:
In the case of promotions and raffles, as well as the organization of events, the purpose is as defined in the participation rules of the promotion, raffle, or specific event, as well as, where applicable, the publication and dissemination, with the consent of the interested party, of their name, surname, image, voice, or any other necessary data for the proper management and greater dissemination of the event or promotion through the media that VALKIRIA ELECTRIC deems appropriate (intranet, newsletters, press, website, social media, etc.), including those located in foreign countries with the legally required guarantees, as well as the sending of commercial communications and profiling if consented to.
In the case of communication campaigns, the data collected from publicly accessible sources based on VALKIRIA ELECTRIC's legitimate interest, or directly from the interested party or from third parties with their consent, may be used by VALKIRIA ELECTRIC for sending commercial communications, in accordance with their commercial profile, if consented to, related to the supply of energy, products, services, as well as to sports, cultural, and charitable activities in which VALKIRIA ELECTRIC participates. These communications may be conducted through the obtained contact means, whether conventional or electronic, or via third-party platforms contracted by VALKIRIA ELECTRIC that are accessible by the user, such as social media, search engines, etc.
a) In the case of processing data from customers and users within VALKIRIA ELECTRIC's digital platforms
The personal data provided by the user for the contracting of products and services will be processed by VALKIRIA ELECTRIC for as long as the contractual relationship with the customer remains in effect. This period will begin at the moment the Contract or Contracts are formalized and will end, regardless of the supply period, once all mutual contractual obligations have been fulfilled, and for a minimum period of 3 years following termination, in compliance with applicable legislation.
If the user has consented, their data may be processed for commercial communication purposes for a period of 2 years following the termination of their contracts or after the user has unsubscribed and does not have any active contracts with VALKIRIA ELECTRIC.
For other users registered on the various platforms (web, apps, etc.), their data will be retained within our digital platforms until the user requests to unsubscribe.
All these periods are understood without prejudice to the data retention obligations required by applicable legislation in each case for addressing responsibilities arising from the processing.
b) In the case of processing data from potential customers in promotions, communication campaigns, and events
If the data comes from third-party sources, the retention period will be as indicated by the information provider, generally corresponding to the validity periods of the public access source used (typically one year) or the duration of the communication campaign.
If the data comes directly from the interested party, this data will be retained for commercial communication purposes for 2 years following its collection.
All these periods are understood without prejudice to the obligation to block data during the period for addressing responsibilities arising from processing in accordance with current legislation.
a) In the case of processing data from customers and users within VALKIRIA ELECTRIC's digital platforms
In the case of contracts, the necessary data for managing access to the network will be communicated to the Distribution Company and will be included in a file under its responsibility (Supply Points Information System – SIPS), to which those determined by the legislation at any given time may have access.
VALKIRIA ELECTRIC also works with third-party service providers, such as sales channels, administrative support, telephone customer service, banks, collection agencies, marketing and advertising, auditing, and others, who may, in certain cases, access your data with the necessary safeguards for the purposes of processing.
VALKIRIA ELECTRIC, in the event of non-payment by the Customer for its services, may report this to creditworthiness and solvency file managers, in compliance with applicable regulations. It may also disclose data to the relevant authorities and competent bodies to fulfill legal and tax obligations. Data related to potential supply contracts will also be communicated to the Tax Administration for the purposes outlined in Law 58/2003, General Tax Law, and/or Law 36/2006, on measures to prevent tax fraud. Furthermore, under Royal Decree 897/2017, the personal data of these customers may be shared with agencies responsible for the protection of vulnerable consumers to implement the measures it provides, as well as with any other administration for legally determined purposes.
The personal data of the customer may be accessed or communicated to other companies located in countries outside the European Economic Area, which constitutes an international transfer of data to those third countries.
VALKIRIA ELECTRIC carries out these transfers, in any case, to (i) countries for which the European Commission has declared an adequate level of data protection, or (ii) in the absence of such decisions, by implementing appropriate safeguards that, following an analysis of the laws of the destination country, ensure the protection of your personal data in accordance with applicable regulations, such as signing standard contractual clauses approved by the European Commission with the receiving entity.
For these purposes, it is noted that VALKIRIA ELECTRIC currently contracts call center services with third-party providers that occasionally operate from countries outside the European Union.

b) In the case of processing data from potential customers in promotions, communication campaigns, and events
In the case of product and service campaigns, the data may be accessed by third-party service providers of VALKIRIA ELECTRIC for the purposes of managing campaigns and sending commercial communications, as well as being shared with third-party collaborators who recommend VALKIRIA ELECTRIC's products and services for tracking the campaign conducted in collaboration with them.
In the case of participation in events and activities, the data may be accessed by third-party service providers or collaborating/organizing companies for the purposes of managing and promoting the activity.
Among the third-party service providers are communication and media agencies, event agencies, photographers, insurance companies, etc.
The interested party can exercise the rights of access, rectification, or, where appropriate, request the deletion of their data when it is no longer necessary for the purposes for which it was collected, among other reasons.
The interested party may request the limitation of the processing of their data in the circumstances established in Article 18 of the GDPR, in which case the data will only be retained for the exercise or defense of possible claims.
The interested party may withdraw their consent at any time, objecting to the processing of their data for a specific purpose, without affecting the lawfulness of the processing based on consent prior to its withdrawal. In the event of an objection to receiving commercial communications, these will include simple and free means to opt out of further communications. Additionally, the interested party can oppose any type of commercial communication by directly exercising their right to object at the contact points of VALKIRIA ELECTRIC detailed below.
The interested party may contact VALKIRIA ELECTRIC to contest any decision that they believe may affect their rights, freedoms, or legitimate interests and that is based on an automated decision, including profiling. This right allows them to challenge such a decision and receive a direct response from the managers of VALKIRIA ELECTRIC.
The interested party may request the portability of their personal data from VALKIRIA ELECTRIC, obtaining an electronic copy either by sending it to the email address they provide or through the corresponding section on the VALKIRIA ELECTRIC website.

Access to the digital platforms through which the USER contracts products or services with VALKIRIA ELECTRIC is carried out in a secure environment. To verify that you are on our Company’s website, check that the word IBERDESARROLLOS appears in the upper status bar. Additionally, you can ensure that you are in a secure environment by looking at the "url" in properties (by right-clicking). This "url" begins with "https," where the "s" indicates that the content is being provided by a secure server.
The digital platforms of VALKIRIA ELECTRIC may provide links to other digital platforms or content owned by third parties in some cases. The sole purpose of these links is to provide the USER with the opportunity to complement their information through these links. VALKIRIA ELECTRIC is not responsible in any case for the results that may arise for the USER from accessing these links.
The USER, and generally any natural or legal person intending to establish any technical linking device from their digital platform to any of VALKIRIA ELECTRIC's digital platforms, must obtain prior written authorization from VALKIRIA ELECTRIC.
